في مجال التطبيق العملي، وهذا الأمر يظهر بوضوح حال ارتكاب الموظف العام جريمة تشكل مسئولية تأديبية وجنائية في أن واحد، ويترتب على ذلك في بعض الحالات ضرورة ارجاء البت في المسئولية التأديبية حتى الانتهاء من البت في الشق الجنائي.
ومن هذا المنطلق؛ قد يكون الحكم صادر بالإدانة، وهذا من شأنه انهاء خدمة الموظف استنادا لقانون الخدمة المدنية ، وقد يكون الحكم صادر بالبراءة ، وهذا يتطلب الوقوف على نوع البراءة إذا كانت شكلية أم موضوعية، حتى يتم استكمال إجراءات نظر الدعوى التأديبية فيما يخص المسئولية التأديبية.
وقد تنقضي الدعوى الجنائية مع استمرار نظر الدعوى التأديبية طبقا للحالات المشار إليها في القانون، خاصة وأن انتفاء الوصف الجنائي لا يمنع من قيام المسئولية التأديبية.

The study on the impact of criminal verdict on disciplinary lawsuits is a significant comparative applied study, that holds great impact in practical application.
And this matter stands out when a state employee action constitutes; both disciplinary and criminal liability, which may lead to deferring the decision on the disciplinary responsibility of until the disposition of the criminal case.
From this perspective; the criminal verdict may lead to the termination of an employee service, based on the civil service law.
The criminal judgement, may be an acquittal and this requires determining whether the acquittal is due to procedural or objective in order to proceed with the disciplinary claim regarding the disciplinary case i.e., the criminal lawsuit may be dismissed meanwhile, the disciplinary claim may still be established according to cases referred in the civil service law.
