شغلت مسألة المقاتلين الارهابيين الاجانب كافة المؤسسات الدولية الرسمية وغير الرسمية نظرا لخطورتها وانعكاساتها على الامن الاقليمي والدولي، وقد سعت الدراسة إلى رصد وتحليل الظاهرة بأبعادها المختلفة، ومعرفة ما تثيره من إشكاليات وتحديات قانونية وسياسية. توصلت الدراسة إلى أن الظاهرة ليست بجديدة على الساحة الدولية، ولكن خطورتها تتمثل بشكل أساسي في تناميها بصورة جلية وواضحة، وامتداد تأثيرها على كافة النواحي ليس فقط الناحية الامنية، وهو ما يستدعى ضرورة تبنى سياسات شاملة لمواجهتها دون الاقتصار على التعامل الامني والعسكري، كما توصلت الدراسة إلى أن منطقة الشرق الاوسط أكثر المناطق عرضة لتهديد هؤلاء المقاتلين الارهابيين الاجانب وخاصة في ظل امتناع عدد من دولهم عن استقبالهم، ورغبة البعض منهم في البقاء في مناطق النزاع والصراعات على أمل استعادة نفوذهم. قدمت الدراسة في خاتمتها رؤية شاملة للتعامل مع معضلات عودة المقاتلين الارهابيين الاجانب، وكيفية تحقيق العدالة الجنائية والانتقالية بشأنهم، حيث تطرح العدالة الانتقالية عددا من الافكار والاستراتيجيات التي ترتبط بمشكلة المقاتلين الاجانب وتعقيداتها من جهة، والقادرة على التركيز على احترام حقوق الانسان من جهة أخرى، مع الاخذ في الاعتبار، أن هذه الرؤية هي مبادئ عامة، وينبغي تكييفها مع السياق الخاص بكل بلد، كما هو الحال في أي عملية عدالة انتقالية أخرى

The issue of foreign terrorist fighters has preoccupied all official and informal international institutions due to its seriousness and repercussions on regional and international security, and the study has sought to analyze the phenomenon in its various dimensions, and to know what legal and political challenges it raises. The study found that the phenomenon is not new to the international arena, but its danger is mainly represented in its growth clearly and clearly, and the extension of its impact on all aspects, not only the security aspect, which calls for the need to adopt comprehensive policies to confront it without limiting itself to security and military dealings, also found that the Middle East region is the most vulnerable to the threat of these foreign terrorist fighters, especially in light of the reluctance of their countries to receive them, and the desire of them to remain in conflict areas in the hope of restoring their influence. In its conclusion, the study presented a comprehensive vision to deal with the challenges of the return of foreign terrorist fighters, and how to achieve criminal and transitional justice for them, as transitional justice proposes a number of ideas and strategies that are related to the problem of foreign fighters and its complexities on the one hand, and capable of focusing on respect for human rights on the other hand, taking into account, that this vision is general principles, and should be adapted to the specific context of each country, as in any other transitional justice process.
