يعد التعثر المالي للمشروعات التجارية هو أحد الظواهر الاقتصادية العامة التي قد تحدث دون ارتباط بأسلوب اقتصادي معين، وعرف جانب من الفقه التعثر المالي بأنه انخفاض في قوة الإيرادات، واحتمال عدم قدرة القائمين على المشروع التجاري على دفع نفقاتها. وبصفة خاصة أعباء ديونها، إذا توافرت هذه الصفات يمكننا وصف المشروع التجاري بأنه في حالة تعثر مالي وظاهرة التعثر المالي للمشروعات التجارية قد يؤدى إليها العديد من الأسباب ويعد من أهمها عدم كفاءة إدارة المشروع التجاري في تسيير نشاطه بالشكل المطلوب فسوء إدارة القائمين على المشروع التجاري، أو فسادهم أحد أهم الأسباب التي قد تؤدى إلى تعثره لما قد ينتج عن ذلك من عدم وجود نظام محاسبي صحيح داخل المشروع التجاري. وكذلك غياب الرقابة على إدارة أموال المشروع التجاري، وكذلك ضعف الرقابة على القائمين على المشروع التجاري، وعدم القدرة على متابعتهم وقد عرف جانب من الفقه المشروع التجاري المتعثر بأنه المشروع الذي يواجه ظروفا عارضة أثرت في نتائج عمله، ولكن لديه الإمكانات الكفيلة الإصلاح مسيرته والنهوض من عثرته إذا توافرت الأسباب والموارد المالية الكفيلة.

Financial distress of commercial projects is one of the general economic phenomena that may occur without being linked to a specific economic method. Some jurisprudence defines financial distress as a decrease in the strength of revenues and the possibility of the inability of those in charge of the commercial project to pay its expenses.In particular, its debt burdens. If these characteristics are available, we can describe the commercial project as being in a state of financial distress. The phenomenon of financial distress of commercial projects may be caused by many reasons, the most important of which is the inefficiency of the management of the commercial project in managing its activity in the required manner. The mismanagement of those in charge of the commercial project, or their corruption, is one of the most important reasons that may lead to its stumbling, as this may result in the absence of a correct accounting system within the commercial project.As well as the absence of oversight over the management of the funds of the commercial project, as well as the weakness of oversight over those in charge of the commercial project, and the inability to follow up with them. Some jurisprudence defines a distressed commercial project as a project that faces temporary circumstances that have affected the results of its work, but has the capabilities to reform its course and recover from its stumbling if the reasons and financial resources are available.
