هدف هذه الدراسة الوقوف على واقع استخدام الزوجة لحق الخُلع في ضوء التمكين القانونيً لها؛ وذلك من خلال الكشف عن السياق الاجتماعي لما قبل الخُلع، والمصاحب له، وما بعده. اعتمدت الدراسة على النظرية البنائية الوظيفية، ونظرية التبادل الاجتماعي، والنظرية النسوية، ونظرية بناء القوة وصنع القرار، ومدخل التمكين القانوني.اعتمدت الدراسة على المنهج الوصفي التحليلي، ودراسة الحالة كطريقة عامة للدراسة، وتم استخدام أداة دليل المقابلة لحالات من الزوجات المُخالعات لأزواجهن بلغت (26) حالة. من أهم نتائج الدراسة: تعثر استمرارية العلاقة الزواجية بين الزوجين، ووجود العديد من الخلافات الأسرية والاقتصادية والنفسية والاجتماعية والسلوكية، وصعوبة التوصل لحلول جذرية للإصلاح أو التغيير، والتي تم على أثرها الانفصال. أن قرار الزوجة برفع دعوى الخُلع ليس قراراً متسرعاً، وإنما هو قرار ناتج عن مشورة المحيطين بها. يمكن للزوجة المتضررة الانتفاع من التمكين القانوني لحق الخُلع بشكل كامل من خلال تعزيز محو الأمية القانونية لها، وتسهيل الخدمات القانونية في إطار مؤسسي وإنشاء المنظمات التابعة للدولة والمجتمع حتى يتسنى لها المعرفة الشاملة بالقانون وكيفية الاستفادة منه.

The aims of this study to examine the reality of the wife’s use of the right to Khula in light of her legal empowerment. This is done by revealing the social context before the khula, what accompanies it, and what follows it.The study relied on constructivist-functional theory, social exchange theory, feminist theory, power building and decision-making theory, and the legal empowerment approach.The study relied on the descriptive analytical approach, and the case study as a general method of study, and the interview guide tool was used for (26) cases of wives who Khulad their husbands.One of the most important results of the study: The faltering continuity of the marital relationship between the spouses, the presence of many family, economic, psychological, social and behavioral differences, and the difficulty of reaching radical solutions for reform or change, as a result of which separation occurred.The wife’s decision to file a Khula suit is not a hasty decision, but rather a decision resulting from the advice of those around her.The aggrieved wife can fully benefit from the legal empowerment of the right to Khula by enhancing her legal literacy, facilitating legal services within an institutional framework and establishing state and community organizations so that she has comprehensive knowledge of the law and how to benefit from it.
