N2  - يعد اللجوء للممارسات غير الرسمية أو التقاضي غير الرسمي أحد الأساليب الأساسية لحصول النساء على حقوقهن في القضايا المتعلقة بالأحوال الشخصية، ذلك على الرغم من التدابير والسياسات التي اتخذتها ومازالت تتخذها الحكومة المصرية لضمانالحقوق الأسرية للنساء سواء من خلال سن التشريعات والقوانين المختلفة أو توفير سياسات الحماية الاجتماعية والمساعدات القانونية اللازمة. فقد كشفت العديد من الدراسات أن النساء هن الفئات الأكثر تضررا من تلك القوانين والسياسات ومازلن يعانين من الكثير من الإشكاليات القضائية والتنفيذية، ذلك فضلا عن العادات والتقاليد التي تمنعهن من اللجوء إلى التقاضي الرسمي; Informal practices or informal litigation are recognized as one of the most significant ways for
women to obtain their rights in personal status problems. Despite the legislations and policies
implemented by the Egyptian government to guarantee family rights for women, whether through
the enactment of various legislation and laws or the provision of social protection policies and
necessary legal aid, several studies have revealed that women are the groups most affected by
these laws and policies, and they continue to face many judicial and executive problems, in
.addition to customs and traditions that prevent them from equality
This study aims at understanding the role of practices in empowering women to attain their rights
in personal status field of, as represented in all informal mediation types (family mediation,
religious mediation and customary mediation including its traditional and new forms) in resolving
family disputes. To achieve the above objective, this thesis hypotheses that formal litigation and
informal mediation, including all mediation parties (disputing spouses, children, family, friends,
community and religious leaders), interact together to help women to attain their rights. Drawing
on adaptation of the socio-ecological model, our analysis using the mixed methodology to
supplement the qualitative data with analysis of a quantitative survey with divorced males and
females that measured their experience towards their disputes in personal status field
