N2  - الوقفَ نظامٌ اجتماعيٌ أصيلٌ يستمدُّ أسسَهُ من الشريعةِ الإسلاميةِ، ويهدفُ إلى تعزيزِ الروابطِ بين الأفرادِ، لأنه يعبرُ عن إرادةِ الفردِ في فعلِ الخيرِ، وهو ينشأُ عن عقدٍ بإرادةٍ منفردةٍ، ويهدفُ إلى تحقيقِ غايةٍ دينيةٍ لها أبعادٌ اقتصاديةٌ واجتماعيةٌ، عاشَ أكثرَ من أربعةِ عشَرَ قرناً كان خلالَها مصدراً للخيرِ، ومنبعاً غزيراً يفيض على جهاتِ البرِّ المختلفة، وقد وقى كثيرًا من الأسرِ الكريمة شرَّ نكباتِ الدهرِ وحفظَ عليها كيانَها. ولأهميتِه القصوى صارَ الحفاظُ على أعيانِه واجباً تقتضيه الأمانةُ وعدمُ التفريطِ فى حقوقِ الآخرينَ، يقعُ فى المقامِ الأولِ على الدولةِ بأن تضعَ الأنظمةَ والأجهزةَ الكفيلةَ بحمايَتِها، والحفاظِ عليها، وواجباً كذلك على من يلي أمرَ الوقفِ، وعلى كلِّ مواطنٍ بحسبِ مكانتِه وصلاحياتِه. وتهدفُ الدراسةُ بشكلٍ أساسىٍ إلى التأكيدِ على ضرورةِ إيجادِ الأدواتِ القانونيةِ الكفيلةِ بصيانةِ الأعيانِ الموقوفةِ، واستثمارِها، والحفاظِ عليها من التعطيلِ والهلاك، والتعرفِ على أهمِّ التصرفاتِ الواردةِ عليها، ومدى توافقِ كلٍّ منها مع الفقهِ الإسلامىِّ الذى يعدُّ بمثابةِ المصدرِ الأصلىِّ لها، والمرادُ بالتصرفاتِ في صلبِ هذا الموضوعِ، التصرفاتُ القانونيةُ التي تردُ على الأعيانِ الموقوفةِ، سواءً التى تقعُ على  أصلِهِ (الاستبدال)، أو على حقِّ الانتفاعِ به(الإيجار والحكر); Waqf is an original social system based on Sharia and aimed at strengthening ties between individuals as it reflects the individual’s willingness to do goodness. It is established under a unilateral contract and aims at achieving a religious objective with socio-economic dimensions. Waqf survived for fourteen centuries as a source for good and prolific wellspring that is pouring upon the various charities, protecting noble families from the effects of the vicissitudes as well as maintaining their unique being. 
Since Waqf has a significant importance, maintaining Waqf properties serves as an honesty demand and an obligation of not to squander the others’ rights. First of all, Country has to issue laws which can protect and maintain Waqf. It is also the responsibility of those who are responsible for Waqf, as well as every citizen whatever his position or power.
The study’s basic objective is highlighting the necessity of developing legal tools that can maintain and invest Waqf Properties and preserve them from disruption and damage. It is also aiming at identifying the main dispositions related thereto, as well as the conformity of each disposition to the Islamic Jurisprudence which serves as their origin. disposition, in terms of this subject, means legal transactions related to the endowed properties whether full disposition of its origin (Replacement), or of its beneficial interest (lease and hikr).
