N2  -  تُعدُّ فلسفة العقوبة الجنائية من الموضوعات الحيوية التي تلامس جوانب متعددة من الحياة الاجتماعية والقانونية؛ حيث تأتي لتُبيِّن وتوضح القيم والمبادئ التي يقوم عليها النظام القانوني في أي مجتمع، كذلك فإنها تُسهم في تحديد كيفية التعامل مع الجريمة وسبل مواجهتها، وكذلك مع المجرمين وكيفية تطبيق العقاب عليهم بما يخدم أهداف المجتمع. وقد تناولت الدراسة الأساس التاريخي والفلسفي لفلسفة العقاب في  المجتمعات القديمة، للوصول إلى جذورها الأولى والتعرف على أساسها القانوني والفلسفي، ، كذلك فقد تناولت الدراسة فلسفة العقاب في النظام الإسلامي، كما تناولت تطور فلسفة العقوبة الجنائية في العصر الحديث، وأهم الأسباب التي أدَّت إلى تطور فلسفة العقوبة الجنائية، وأهم مظاهر هذا التطور في العصر الحديث. وأخيرًا عرض الباحث لأهم النتائج التي توصَّل إليها بصدد البحث في فلسفة العقوبة الجنائية والتوصيات المقترحة; Criminal punishment philosophy is one of the vital topics that touches upon multiple aspects of social and legal life; where it comes to explain and clarify the values and principles upon which the legal system in any society is based. It also contributes to determining how to deal with crime and ways to confront it, as well as with criminals and how punishment is applied to them in a way that serves societal goals. The study addressed the basic historical and philosophical foundation of punishment philosophy in ancient societies, to reach its earliest roots and understand its legal and philosophical basis. The study also addressed punishment philosophy in the Islamic system, as well as the development of criminal punishment philosophy in modern times, the most important reasons that led to the development of criminal punishment philosophy, the most significant manifestations of this development in modern times.  and finally, the researcher presented the most important conclusions he reached regarding research on criminal punishment philosophy and proposed recommendations
