N2  - هدف البحث إلى بيان أدلة القاعدة محل الدراسة، وشروط إعمالها، وبيان الأثر الفقهي لها من خلال التطبيق الفقهي على المسائل الفقهية في أبواب الفقه، وبيان المسائل المستثناة من القاعدة محل الدراسة، واقتضت طبيعة البحث والموضوع أن يكون من مقدمة، وفصل تمهيدي، وخمسة فصول، وخاتمة. مقدمة: اشتملت على أهمية الموضوع، وأسباب اختياره، والدراسات السابقة له، ومشكلته، وأهدافه، ومنهجه، وخطته. فصل التمهيدي: مقدمات تأصيلية لمصطلحات البحث. الفصل الأول: تطبيقات القاعدة على مسائل العبادات من طهارة. الفصل الثاني: تطبيقات القاعدة على مسائل أحكام الأسرة.الفصل الثالث: تطبيقات القاعدة على مسائل المعاملات. الفصل الرابع: تطبيقات القاعدة على مسائل الحدود والجنايات. الفصل الخامس: الاستثناءات من القاعدة. الخاتمة: فيها أهم النتائج والتوصيات التي توصل إليها الباحث; The research aimed to clarify the evidence for the rule under study, the conditions for its application, and its jurisprudential impact through its application to jurisprudential issues in the chapters of Islamic jurisprudence, as well as to clarify the issues exempted from the rule under study. The nature of the research and the topic necessitated an introduction, a preliminary chapter, five chapters, and a conclusion. Introduction: It included the importance of the topic, the reasons for its selection, previous studies on it, its problem, its objectives, its methodology, and its outline. Introductory chapter: Foundational introductions to the research terms. Chapter One: Applications of the Principle to Issues of Worship from Purity. Chapter Two: Applications of the Rule to Family Law Issues.
Chapter Three: Applications of the Rule to Transaction Issues. Chapter Four: Applications of the Rule to Issues of Hudud and Crimes. Chapter Five: Exceptions to the Rule. Conclusion: It contains the most important findings and recommendations reached by the researcher
