<br/><br/> The current PPP utilization volume in MENA region is considerably low as compared to other world regions. This is caused by several barriers including the legal barriers which remain one of the most significant determinants of the successful implementation of PPPs, where the currently existing legal frameworks in MENA region have a wide room for enhancement and improvement. Hence, this thesis focuses on overcoming such a legal barrier through proposing appropriate alterations to the currently existing PPP-related legal framework in MENA region to ensure promoting the utilization of the PPP arrangements and thus, obtaining the optimum benefit from the application of PPP.  This is done through discussing the legal frameworks initiated by governments in MENA region and worldwide in their efforts to enhance and regulate the implementation of PPPs, as well as conducting a comparative study between the PPP legal frameworks in MENA and worldwide.  إن حجم الاستفادة الحالية من الشراكات بين القطاعين العام والخاص في منطقة الشرق الأوسط وشمال أفريقيا منخفض إلى حد كبير مقارنة بمناطق العالم الأخرى. ويرجع ذلك إلى عدة عوائق من بينها العوائق القانونية التي تظل أحد أهم محددات التنفيذ الناجح لهذه الشراكات، حيث أن الأطر القانونية القائمة حاليًا في منطقة الشرق الأوسط وشمال أفريقيا لديها مجال واسع للتحسين والتطوير. ومن ثم، تركز هذه الرسالة على التغلب على هذه العوائق القانونية من خلال اقتراح التعديلات المناسبة على الاطر القانونية الحالية في منطقة الشرق الأوسط وشمال أفريقيا المتعلقة بشراكة القطاع العام والخاص لضمان تعزيز الاستفادة من ترتيبات هذه الشراكة، وبالتالي الحصول على الفائدة المثلى من تطبيقها.  ويتم ذلك من خلال مناقشة الأطر القانونية التي قامت بوضعها الحكومات في منطقة الشرق الأوسط وشمال أفريقيا والعالم في جهودها نحو تعزيز وتنظيم تنفيذ الشراكات بين القطاعين العام والخاص، فضلاً عن إجراء دراسة مقارنة بين الأطر القانونية للشراكة في منطقة الشرق الأوسط وشمال أفريقيا والعالم.
