ال دِرَاسَةٌ مُقَارَنَةٌ A comparative study ،سِنْدِيَانَةُ أَحْمَدَ رَمَضَانَ بُودِرَاعَةٍ creator إعداد. أَحْمَدُ عَوَضٍ بِلَالٍ مشرف أطروحة. text theses ua 2025 monographic eng ara ara 420 صفحة : إيضاحيات ؛ 30 سم. + CD. يُعد موضوع البحث من القضايا المهمة التي تفرض نفسها على الساحة الدولية والوطنية في الوقت الحاضر، إذ يُشكل عائقًا أساسيًا أمام التنمية في مختلف مجالاتها، ولا شك أن ظاهرة الفساد قديمة قدم المجتمعات البشرية، ويرتبط وجودها بوجود النظم السياسية والإدارية، سواءً أكانت ديكتاتورية أم ديمقراطية، وهي تتفاوت من مجتمع لآخر، ومن دولة لأخرى، باختلاف ثقافاتها. يهدف البحث إلى تسليط الضوء على السياسة الجنائية لمكافحة جرائم الفساد، والتي تتمثل في مجموعة الوسائل والإجراءات التي تتخذها الدولة في فترة زمنية محددة لتجريم هذه الظاهرة ومواجهتها بالعقوبات والوسائل الوقائية للحد منها. أظهرت الدراسة أن ظاهرة الفساد قد تفاقمت في ليبيا رغم التشريعات الجنائية التي شُرّعت لمواجهتها، إلا أن تطبيق هذه التشريعات أظهر ضعفها في إيجاد حلول عملية لبعض التحديات، لا سيما مع تطور أساليب هذه الجرائم وأساليبها في الوقت الحاضر. لذا، طالب الكثيرون بتحسين القواعد الموضوعية ومراجعة العديد من القضايا.وتتعلق هذه التحديات بسياسات العقاب والتجريم التي لا تفي بالمعايير الدولية والوطنية للحد من خطر الفساد وآثاره. لذا، يُعدّ الحفاظ على خصوصية هذه الجرائم أمرًا بالغ الأهمية لتحقيق الفعالية والغرض المنشود. ويمكن تحقيق ذلك بنجاح من خلال وجود قواعد جنائية وإجرائية موضوعية لجرائم الفساد.والسبب في ذلك هو أن القواعد العامة لا يمكن أن تغطي جميع جوانب الفساد، لا سيما عند النظر في مبدأ "لا جريمة عقاب بدون قاعدة". وهذا يجعل من الضروري تحديد أركان وشروط وعناصر تجريم جميع جوانب الفساد. بالإضافة إلى ذلك، يتطلب الأمر عقوبة جنائية مناسبة لهذه الجرائم لتحسين المسؤولية الجنائية؛ وإلا، لا يمكن تحقيق هذه المسؤولية تجاه المفسدين. The subject of the research is one of the important issues that impose itself on the international and national arena at the present time as it constitutes a fundamental obstacle to development in its various fields, and there is no doubt that the phenomenon of corruption is as old as human societies and its existence is linked to the existence of political and administrative systems, whether they are dictatorial or democratic regimes, and these vary. The phenomenon is from one society to another, and from one country to another, with different cultures of each.Study showed that the corruption phenomenon has increased in Libya in spite of the criminal rules which have been legalized to be applied in order to face it. The application of these rules illustrated their weakness in finding practical solutions for some challenges particularly due to the improvement of such crimes ways and methods today. Thus, many asked to improve the objective rules and to revise many issues. Such challenges are related to the punishment and incrimination politics which do not meet the international as well as national standards for eliminating the danger of corruption and its effects. Hence, maintaining the privacy of such crimes is very necessary to achieve both efficiency and the potential purpose. This can be successfully done through having objective criminal and procedural rules for crimes of corruption. The reason for this is that general rules cannot cover all the aspects of corruption specifically when considering the principle of (there is no crime of punishment without a rule). This makes it very necessary to specify the parts, conditions and elements of incriminating all sides of corruption.
