يعد الانتخاب الدعامة الاساسية لنظام الحكم الديمقراطي ، ومن هنا يظهر الانتخاب كوسيلة للاتصال بين الحكام والمحكومين أى يتولى الشعب حكم نفسه بنفسه بطريق مباشر أو غير مباشر. و يعود سبب اختيار موضوع البحث إلى أن موضوع الانتخابات من أهم الموضوعات المطروحة على الساحة السياسية والاعلامية ، والاحداث والتطورات التى مرت بها مصر وارتباط ما حل بمصر من ازمات بالانتخابات التى تمارس فى ظل قوانين لا تكرس النظام الديمقراطي ، ولا تضمن المساواة بين المرشحين ، بالإضافة إلى تجاوز سقف الانفاق المحدد فى الحملات الانتخابية ، وانتشار الرشوة الانتخابية ، مما أدى إلى فقدان الثقة وعزوف الناخبين عن الانتخابات ، فالانتخابات هى أهم خطوات الاصلاح السياسي فى سبيل اعادة السيادة للشعب ليتولى ممارستها ديمقراطيا من خلال صناديق الاقتراع . وما يميز دراستنا لهذا الموضوع هو الاعتماد على التقنين الجديد الذى جاء به المشرع المصرى بقانون تنظيم مباشرة الحقوق السياسية رقم 45 لسنة 2014، و قانون تنظيم الانتخابات الرئاسية رقم 22 لسنة 2014 ، فضلا عن أن الجرائم الانتخابية كانت ومازالت تلعب دورا جوهريا فى التأثير على سلامة ونتائج العملية الانتخابية

Election is the mainstay of the democratic system of government; hence the election appears as a means of communication between the rulers and the ruled, that is, the people assume the rule of themselves by themselves, directly or indirectly.
The reason for choosing the topic of the research is that the issue of elections is one of the most important issues raised in the political and media arena, the events and developments that Egypt has gone through and the link between the crises that have occurred in Egypt with the elections that are practiced under laws that do not enshrine the democratic system and do not guarantee equality between candidates, in addition to Exceeding the spending ceiling specified in the electoral campaigns, and the spread of electoral bribery, which led to a loss of confidence and the voters’ reluctance to vote. Elections are the most important steps for political reform in order to restore sovereignty to the people to exercise it democratically through the ballot boxes.
What distinguishes our study of this subject is the reliance on the new codification brought by the Egyptian legislator by Law No. 45 of 2014 regulating the exercise of political rights, and Law organizing presidential elections No. 22 of 2014, in addition to the fact that electoral crimes were and still play a fundamental role in influencing the safety and results of the electoral process.
